Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Mindscape application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Mindscape ("we", "us", or "our").

2. Description of Service

Mindscape is a meditation and breathing application that provides:

• Guided breathing exercises — visual breathing animations with customizable rhythms
• Ambient soundscapes — curated sound environments for relaxation, focus, and sleep
• Session tracking — local history of your meditation practice

The App operates entirely offline. No internet connection is required for any feature.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and Conditions.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Distribute, sublicense, or transfer the App to third parties
• Use the App for any commercial purpose without our prior written consent

4. Intellectual Property

All content included in the App — including but not limited to text, graphics, logos, icons, images, audio files, software, and design elements — is the property of Mindscape or its content suppliers and is protected by international copyright and intellectual property laws.

The ambient sound recordings bundled in the App are licensed for use within Mindscape only. You may not extract, redistribute, or use these audio files outside of the App.

5. User Responsibilities

By using the App, you agree to:

• Use the App only for its intended purpose of meditation and relaxation
• Not attempt to interfere with the App's functionality or security
• Comply with all applicable laws and regulations

6. Health Disclaimer

Mindscape is designed for general wellness and relaxation purposes only. The App is not a medical device and does not provide medical advice, diagnosis, or treatment.

• The breathing exercises and meditation content are not substitutes for professional medical or psychological care.
• If you have any health conditions, particularly respiratory, cardiovascular, or mental health conditions, consult a healthcare professional before using the App.
• Do not use the App while driving, operating heavy machinery, or in any situation where drowsiness or distraction could pose a safety risk.
• Stop using the App immediately if you experience dizziness, discomfort, or any adverse symptoms.

7. In-App Purchases

Mindscape V1.0 is free to use with no in-app purchases. If future versions include optional purchases:

• All transactions will be processed through Apple's App Store and subject to Apple's terms.
• Pricing and availability will be clearly displayed before purchase.
• Refund requests should be directed to Apple Support.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• In no event shall Mindscape be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability shall not exceed the amount you paid for the App (currently $0).

9. Third-Party Services

The App does not integrate with or link to any third-party services. Any websites or services you access from links in our legal pages (e.g., GitHub Pages) are governed by their own terms and policies.

10. Termination

These Terms are effective until terminated. You may terminate this agreement at any time by deleting the App from your devices. We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date on this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
